Wills
Will with Minor’s/Young Adult Testamentary Trust
Every Will I prepare includes a Testamentary Trust, which is created by the Will itself and takes effect only if an inheritance is passing to a beneficiary who is 25 or younger or is incapacitated. This trust is essential for protecting minor beneficiaries by eliminating the need for court-appointed guardianship, ensuring their inheritance is properly managed.
Key Benefits of a Testamentary Trust:
✔ Avoids Guardianship: Ensures that minors inherit without the delays and expenses of court-appointed guardianship.
✔ Financial Maturity: The trust typically lasts until age 25, allowing young adults time to develop financial responsibility before receiving full access to their inheritance.
✔ Lifetime Protection for Incapacitated Beneficiaries: If a beneficiary is incapacitated, the trust can provide ongoing financial support and asset management for their lifetime.
✔ Creditor & Divorce Protection: Assets in the trust are shielded from creditors, lawsuits, and potential claims in the event of divorce, safeguarding the beneficiary’s inheritance.
✔ Controlled Distributions: The trust allows funds to be used for important needs like education, healthcare, and living expenses, ensuring responsible use of the inheritance.
Starting at $750.00 per person.
Will with Tax Planning Trusts
For large estates it is often necessary to have a Will that includes tax planning trusts. This is an advanced estate planning technique to help shelter and protect large estates from estate tax. In addition, a significant benefit to such trusts is that you can continue to shelter financial growth from estate tax even after you have passed. This ensures that you can leave a legacy that will benefit your loved ones for generations.
Starting at $1500.00 per person
Revocable Living Trusts
Revocable Living Trusts
Every Revocable Living Trust I prepare is designed to provide seamless asset management and protection while avoiding the delays and costs of probate in most cases. Unlike a Will, a Revocable Living Trust takes effect during your lifetime and ensures that your assets are managed according to your wishes both during incapacity and after your passing.
Key Benefits of a Revocable Living Trust:
✔ Avoids Probate (in Most Cases): Assets held in the trust typically pass directly to beneficiaries without the delays, expenses, and public record of probate.
✔ Incapacity Planning: If you become incapacitated, a successor trustee can manage your assets without the need for court intervention.
✔ Privacy Protection: Unlike a Will, which becomes public in probate, a Revocable Living Trust keeps your estate details private.
✔ Flexibility & Control: You retain full control over your assets during your lifetime and can modify or revoke the trust as needed.
✔ Efficient Asset Distribution: Ensures a smooth transition of assets to beneficiaries without court delays, reducing stress and legal costs for your loved ones.
Starting at $3,000.00 per single person.
Starting at $3,500.00 for a married couple
Powers of Attorney and Medical Documents
Financial Power of Attorney
A financial power of attorney is a very important document that is effective while you are alive. This document names an agent (and back up agents) who can step into your shoes and handle most any type of financial matter on your behalf. This document becomes particular important if you become incapacitated because your named agent would be able to access your accounts and handle financial matters for you.
*Included in Will or Trust Plan. If preparing separately cost is $150.00
Medical Power of Attorney
A medical power of attorney is an important medical document that names an agent (and backup agents) who can step and handle medical decisions on your behalf if (1) you are unable to do so yourself, or (2) you become mentally incapacitated.
*Included in Will or Trust Plan. If preparing separately cost is $50.00
HIPPA Authorization
A HIPPA authorization is an important medical document that indicates (1) who can speak to medical personnel, and (2) who can request and receive medical records. This document is very important if you show up at a hospital unconscious because you will not be able to fill out a HIPPA release in that instance.
*Included in Will or Trust Plan. If preparing separately cost is $50.00
Directive to Physicians
A directive to physicians is an important medical document that indicates your wishes regarding life support if life support is the only thing keeping you alive (and there is no chance of recovery in the determination of your physician). This document is often confused with a Do Not Resuscitate order or DNR. A DNR is a medical order that must be signed by a physician. That document only deals with resuscitation and does not deal with life support.
*Included in Will or Trust Plan. If preparing separately cost is $50.00
